    sorry to interupt... have you seen a copy of the Seante judiciary immigration bill in it's final form going to the floor. I can't find it anywhere.

      It's basically Specter's Bill, with 115k H-1Bs NEW added yearly, if cap hit, automatic 20% increase.
      Doesn't include the existing H-1Bs the other exemptions, i.e. the 20k for US graduate school, eng, ma, sci and so on.

      For all those offended by the reference, forgive me, these guys at least put up updated info.

        Was it you who informed me that Specter's bill gets rid of the attestation requirement?

        Does anyone know if the attestation requirement has been gutted from the H1B requirements in this new bill?

          I can't find it w.r.t Specter's bill...not saying it's not there though.

          Seemingly the "devil in the details" is under separate DOL requirements.

          I'm seeing books and websites devoted to being classified as a "priority worker" which means they don't have to advertise to Americans.
          I see a "reduce paperwork" act claiming it's "such a pain" to have to advertise the position to Americans first before getting the H-1B.

          I also see a new classification for H-1B contract houses...(this might explain why we see those jobs ads stating "H-1Bs only need apply") if they use 15% or greater H-1B exclusively in the US, they have to advertise the job.

          Anyway, bottom line I don't know...

          I mean the DOL is so corrupt, they aren't going to enforce any of the law anyway so since no one is focused on fixing the DOL to actually represent the interests of workers, I have paid no attention to this.

            Companies have been able to use H1-Bs for some time without having to claim that no American can fill the job.  I think that requirement stopped around 1997 but I'd have to look it up again.  Perhaps there was some such requirement in the new proposal. But Norm Matloff, the CS professor and gadfly from UCD, has been explaining for a long time that the "prove that you can't find an American to do the job" requirement hasn't been the law for a long time.

        I watch the hearings and matched it up as best as I could with Specters mark up, but in the end the devil will be in the detials and we won't know them until we see the final bill.

          How about writing a diary with a lot of detailed labor economics references w.r.t. to the bill when you get it.

          cutting through the emotionalism and getting to some objective facts and projected affects on US labor markets ...

          might be useful to assist in cutting the wheat from the shaft over here.
