    Look, there is NO REASON why Bush can't be indicted. There is nothing in the Constitution that says that the president can't be indicted. In fact, indictment is PRE-CURSOR to impeachment, not the other way around.
    Ever since Nixon was named as an un-indicted co-conspirator, the FALSE notion that a sitting president can't be indicted has been circulated.

    Nixon was named as an un-indicted co-conspirator to prevent him from using the presidential pardon to pardon his conspirators before they could be tried.
    (Bush Sr did this in Iran-Contra)
    Pardoning the Watergate burgalers would have confirmed Nixon's complicity and made bold and undeniable his criminal abuse of power. Naming Nixon as an un-indicted co-conspirator was a brilliant legal move to head off a criminal abuse of the pardon power.

    Nixonite Neocons have tried to FALSELY turn this particularly bitter pill for them, into a shield of invulnerability for an imperial presidency.

    The Constitution says that the president can be impeached and removed from office for "high crimes and misdemeanors." And it specifies how the president would be impeached and removed from office.
    However, the constitution does NOT specify that the president can't be held accountable for crimes unless he is impeached. The impeachment process is for the removal of a president who is a criminal.

    The belief that a sitting president can't be indicted is ONLY A BELIEF.

      this has always bugged me.

      What did the framers mean by misdemeanors.  Are there high misdemeanors?

      My feeling is that we might not get him on high crimes but surely something he has done is at least a misdemeanor. Can someone give me a real legal defination for this term as it applies to impeachment.
