    before the breakfast.  His official statement on the vote was posted to his website yesterday:

    Based on the testimony he gave during his confirmation hearing and in follow-up letters to the judiciary committee, Michael Mukasey is not the right man for this job. [...] Smith still refuses to say publicly whether he thinks waterboarding is torture. But his vote for Mukasey says it all. He stands with President Bush. He stands with Mukasey. And he stands against the values of Oregonians he is supposed to be representing.

      with respect, that doesn't answer either the hold or filibuster questions. Voting against was a given, I would say.

      And I'd be interested to hear Steve Novick's response, although it's an easy hypothetical since neither will get to actually vote or participate.

        I was reading too little into the question and between the lines on the response.  I will be pleasantly surprised if either candidate chooses to speculate with that level of specificity on when and if they might use holds and filibusters.  Both candidates do better than most on addressing the underlying issues.
