Technically she voted against the Constitutional Amendment, but co-sponsored a proposal to simply make it illegal by law.
Senators began debating the amendment Monday, along with an alternative proposal from Sens. Hillary Clinton, D-New York, and Bob Bennett, R-Utah. They wanted to ban flag desecration by law rather than by constitutional amendment.

You would never pass that. It comes up all the time, and even though it polls well, its an issue that isn't worth compromising on.

but S.Ct. justices can evolve while on the bench, Hugo Black went from being a segregationist senator to one of the greatest champions of civil liberties in the history of the court.
I think Hillary's a little old to be chosen, given the stakes. But other than that, I don't think it would be a terrible choice.
