the 5th Amendment prohibits takings for a private benefit. And Berman, Midkiff and Kelo all say so.
this issue in Kelo was whether or not "economic development" constitutes a public use/benefit, and the court said it does. At the same time the court affirmed that the constitution prohibits eminent domain for a private benefit.
