Bush proudly 'fessed up to spying on Americans without a warrant, and he also proudly admitted to authorizing torture.  Hell, going back to the start of the Iraq war, Bush re-appropriated Afghanistan funds for it, and that's expressly unconstitutional.

Since around 2004, the "we don't have the evidence yet" argument has been nothing more than a rationalization for inaction.
