  •  Liberty Univ lawsuit against bill for religion (4+ / 0-)

The Christian Science Monitor reports that Liberty University and Thomas Moore Law Center have filed separate lawsuits against the new bill:

The Thomas More Law Center in Michigan and Liberty University in Virginia, abortion foes, each filed suit challenging the new healthcare reform law. The law treats religions unequally, they say, and forces adherents to be part of a healthcare system that violates their religious beliefs on abortion

    .

Specifically, they note that the law exempts certain "recognized" religions from compliance with the healthcare insurance mandate. The law offers some groups a religious exemption from participation in the new reform effort, but not other religious groups. This discrimination is an unconstitutional entanglement between government and religion, they say.

The Constitution’s First Amendment says in part that "Congress shall make no law respecting an establishment of religion."

"The act’s religious exemption violates the Establishment Clause in that it grants to [the executive branch of the national government] discretion to determine which religion is ‘recognized’ and demonstrates a preference for one denomination over another," the Liberty University suit says.

The Thomas More Law Center suit raises a similar argument but says the new law violates the Fifth Amendment’s guarantee of equal protection.

    •  Thomas Moore... (9+ / 0-)

the same losers that lost the Intelligent Design Creationist lawsuit in Dover PA, and cost Dover PA $1.1 million.  That Thomas Moore. The one that the opposing counsel made look like grade-schoolers vs. Real Life Lawyers.  This case will be argued just as carefully, I hope.

And Liberty U?  Isn't that Falwell's miserable excuse for a real university?

that they'll be spending yet another boatload o' cash to lose this lawsuit.  Couldn't happen to a more deserving bunch of yahoos.

        Oh, and...

The one that the opposing counsel made look like grade-schoolers vs. Real Life Lawyers.

This made me wonder how many of Liberty U's students even went to grade school?  I'd be surprised if the vast majority weren't homeschooled, with the rest having gone to fundie private Christian schools.
