    Apart from all of the doomsday assumptions you make, you fail to explain why a southern state hasn't successfully challenged the constitutionality of the VRA, which of course the regulated states have had an opportunity to challenge for 40 years now.  If it is for fear of bringing suit and appearing racist, I would imagine that same fear would apply to any state that wished to challenge the VRA - what state would want to appear responsible for nullifying the Civil Rights Movement?  And, what court would do the same?  It's the same reason Miranda will never be overturned, despite the fact that a majority on the Supreme Court would probably overturn it if it had no historical significance.  No one wants to be on the wrong side of history.  Any challenges would likely be on factual, and not constitutional, grounds.
