    The courts are unable to clarify this in anything but the most fractured, long-winded and convoluted opinions. Might as well call this a political question and call it a day.

      then how wild of a plan could Congress or a legislature implement, once they didn't have to worry about judicial oversight?  I haven't yet read Kennedy's opinion, but I have a hard time believing this is really what he believes.

      My apologies to students who took my U.S. Government class in the 90s: evidently the Constitution doesn't limit Presidential power after all. Who knew?
