Most states are ok with you killing an intruder in self-defense.  I only say "most states" because I am not familiar with the laws of all states but I have never heard of someone protecting themselves being thrown in jail.

Additionally, and I don't want to take away from the seriousness of shooting a gun at someone, they are not always lethal.  It all depends on where you hit the attacker and some on luck.  If you kneecap someone they will be in great pain but not die.  On the other hand, if someone is attacking you, you don't have time to strategize of that and hope you don't miss.

Personally, I advocate a shutgun as a home defense tool if a person feels that it is necessary to own a gun.  The shot will not go through the wall if you use normal buckshot or birdshot, you don't have to have 100% accurate aim since the shot goes from one pellet the size of a pencil to being many pellets hitting the area of a small plate from far away.  However, I do not want people to have guns who will not be responsible with them, so I only advocate it for people who will keep them locked up and safe, and would be careful when using it.

Also, tasers can be fatal as well.
