  •  Also liable for $500 per call nationwide (0+ / 0-)

The robocalls that mislead the listener as to the source of the call are also likely subject to a $500 per call penalty due to violating the Telephone Consumer Protection Act.  The TCPA created FCC regulations that require every automated phone call to clearly state who the call is being made on behalf of at the beginning of the call. They also have to provide a callback number.  So any robocalls nationwide that deceive about their source (they don't clearly state who they're from at the beginning of the call), whether they're to do-not-call-registry members or not, may be liable to a $500 fine, or up to $1500 if the violation was found to be willful.

That's a lower fine than NH, but it potentially covers a much larger number of violations.  We really need to look into pursuing this after election day.
