    the Repubs. could filibuster the organizing resolution regardless of whether or not Johnson is able to participate.  They have 49 votes either way, which is enough to fend off a cloture motion.  I agree the chair would still rule and the Dems. could overrule the chair with 50 or 51 votes.  I don't see how Johnson's condition makes any difference.  They could still try this trick either way.  His temporary incapacitation only makes the move seem more goolish.

    Also, there is apparently no way for the Repubs to actually prevail in the end (i.e., we can overcome any Cheney ruling from the chair by a simple majority vote).  So Harry should count heads (i.e., make sure JL doesn't have any crazy ideas), and tell the Repubs "No Deals!"
