    Another question Marcy - Last night I diaried about the new motion that Fitz filed Thursday:

    GOVERNMENT’S MOTION IN LIMINE TO ADMIT NONDISCLOSURE AGREEMENTS EXECUTED BY DEFENDANT

    I caught this over at TalkLeft last night.  Have you read it, and do you have any opinions about it?  I haven't checked yet to see if Christy has a take on it or not.

      I think it may be due to two things. First, if Fitz has learned he can introduce some of the NIE stuff (since Libby wants to put all these journalists on the stand, he might), then the non-disclosure becomes more important. Ditto the trip report details. If Fitz now feels that he can go after the trip reports, then he may want the nondisclosure agreements in.

      But it also may be a tactic to ensure they can introduce the 12 October WaPo article, which Libby annotated. They're going to introduce it to show evidence of guilty intent. But Libby's team will fight this mightily. By raising the nondisclosures, you raise the chances of getting this article in.

      Btw, both sides are introducing WAY more evidence than originally expected. For example, Fitz' team tried to introduce the original 1X2X6 article--even though they hadn't listed it among the articles they would submit. And Libby's team has introduced every article ever written in this period, even though they fought the introduction of the same articles in the pre-trial period.

        the TNR article?  It seemed to they skipped around it in the opening.

          And curiously, Eric Edelman was not called by the Prosecution. THey've done everything in chronological order so far, which would put Edelman before Ari. So I wonder whether they're going to call him at all.

          It looked like Defense was trying to establish some stuff on edelamn with martin, but it's not clear what that was.

            was a source (or assumed to be a source by Cheney/Libby) for the articles about crushed dissent in the IC.

            I wonder if Edelman was simply a bad witness (like Miller) or if Fitz is saving him for the next case he hopes to bring.
