    Real privatization is a solution. Not selling prisons to the most politically-connected bidder, but actually giving prisons to the guards - the only logical solution I can think of. At the same time, hold them responsible for crimes that occur on their watch - just like any other private entity is responsible for ensuring the safety of those they have taken guardianship of, guards should be held accountable for failing to prevent rape.

        Talk about a "solution" that is sure to make the problem far, far worse.  You want to turn prisoners over to the tender mercies of the Charles Graners of the world, and only deal with the inevitable abuses after they happen?  That is inhumane.

        Because the government doesn't have to hold itself accountable. Remove the problem from government, and the free market will work its magic. If guards are held accountable, they won't work at prisons that don't protect prisoners (and therefore guards). They will be overly vigilant in ending prison rape because they aren't given coercive authority to remain above the law.

        I can't imagine a system of justice that even pretends to be fair if it deals with abuses before they happen.
