    the MA legislature passes a law ASAP that will allow them to appoint his replacement.

      Just the opposite, I would think.

      If he resigns now (now being before some magic date, in June if I recall correctly), we get to elect a new senator in November 2004.  If he doesn't resign by the magic date, the appointed replacement isn't up for a vote until November 2006.

        but that would just bring up more "flip-flopper" charges. I don't know. I really worry about that seat going to a GOP even for a few months, because the Republicans are starting to gain momentum in MA thanks to millions and millions of dollars and anger at the Democrats on various issues (the convention, same-sex marriage, Fineran).

        I also would prefer to have that sure anti-FMA vote, in case they get as many votes as I think they will in support of the measure.
