    they did. it was a federal court, and the court was upholding their de facto constitutional right to act in any not unlawful manner.

      I didn't see anything in the court of appeals opinion on the constitution (wasn't mentioned once), and if the FCC had made it's 'news distortion' policy a regulation subject to notice and comment, then it would have qualified as an 'adopted rule or regulation' and, presumably, the Plaintiffs would have won.

      I suppose you could make some sort of argument involving the constitution, but I don't see that from anything in this diary or the court of appeals case.

      I wouldn't harp on this, but this diary's on the recommended list, and we all like to pride ourselves on getting the facts right.
