A girl not yet of age is not capable of 'consenting to sex'.  I'm the father of a 9-year old daughter, so perhaps I see things a bit differently from those who are cheering this pedophile's release.  I think that any boy who talks an underage girl into sex is a criminal.  If the boy is underage themselves, then the punishment should be less severe, and he should not be treated as an adult.  If this kid was soooo smart, then perhaps he should have thought more with his upper head than his lower head.

That being said, the enforcement of these laws in this country are clearly uneven. Was this kid prosecuted because of his skin color?  Probably.  I think that if his defense lawyers can show that white boys in similar situations were NOT prosecuted, then he should be released or given a lighter sentence equivalent to the sentence given white boys.

If a 'boy' over the age of 18 has sex with a girl under 18, he should be tried as a rapist and sent to jail.  Period.

My wife is a teacher at a middle school, and one of her 8th grade students is pregnant.  There are probably a LOT of people at fault for that, including the girl.  But the father should be held accountable.

    Sorry for the mini-rant.

If Wilson had had sexual intercourse with the 15-year-old he would have fallen under Georgia's "Romeo and Juliet" exception. But under the law in 2003, oral sex between teens constituted aggravated child molestation and carried a mandatory sentence.

Georgia lawmakers changed the law in 2006 to make consensual oral sex between teens a misdemeanor punishable by a maximum of one year behind bars. Offenders do not have to register as sex offenders, as Wilson will be required to do.

Boy is 18 and a day, and the girl is 17 and 11 months? Put him away and ruin his life? Girl is 18, boy is 17? If those are OK, then how big an age difference is OK? Seems sensible to me to set a range like about 2 years of gray. I say this as a father of twin 13 yo girls and a 19 yo boy.

Honestly, if I were you, I'd get a more realistic perspective before your daughter hits puberty.

    •  He wasn't over 18. He was 17. (10+ / 0-)

They were both kids. One was barely over the age of consent, one just barely under. They were, to a first approximation, the same age.

And the evidence seems to be that she talked him into having sex.

Seeing as you're the father of a 9-year-old girl, I'll cut you some slack, but you're being irrational. Healthy teenagers have had sex with their age contemporaries since the beginning of recorded time -- and in fact, long before that. It's coded in our genes. You are completely wrong to call him a pedophile. A pedophile is a fully grown adult who pervertedly preys on young children. A couple of teens groping each other in mutual lust is not perverted at all, it's normal and healthy. We just happen to have created a society where we foolishly expect humans to remain infantile until they reach an arbitrary cutoff instant, at which point suddenly they're adults.

It's more of the same either/or thinking that causes so much trouble in the debate over abortion.

By the way, the age of consent is 16, in Georgia. This number varies state by state (though human biology does not, and a teenager will in fact mature at the same pace regardless of what local laws happen to be). If you think 18 should be the age of consent, then by your measure he was a minor, too.

Have you actually checked what the age of consent is in your state? It's kind of a scrambled mess. Law doesn't cope well with gray areas, especially ones connected with sex. You might be surprised to find it's not 18...

Clearly (hopefully?), you don't also have a son.  Your righteous parental indignation might change a bit.

Honestly, take a moment to think.  You have a son. He's at a party, a girl comes over to him and starts giving him a blow job.  She's in high school with him, but she happens to be two years younger.  Your son should now go to jail for - what?  Not pushing her away fast enough?  Would you expect him to have done so?  Would you agree with people who want to put him in jail and throw away the key?

And now, imagine that this hypothetical son of yours has been dating a girl throughout high school - maybe he even wants to marry her.  Like most couples, they were not born on the exact same day - she's a few months younger.  You are seriously telling me that you would have no problem with the state sending your son to jail for having oral sex with his longtime girlfriend one day after his eighteenth birthday?  Because, by your logic, he should be "tried as a rapist and sent to jail. Period."

of, say, 17 years of age have sex, they'd better have the same birthday, right?

I mean, one of them might be 18 for a few months before the other one turns 18, which will magically turn all their sex into rape.

      Right?

If a 'boy' over the age of 18 has sex with a girl under 18, he should be tried as a rapist and sent to jail.  Period.

You are a fucking moron, and I say that as the father of a daughter.
