    I can't for the life of me why the case has actually gotten this far - I can't imagine that the defense attorney did not file a motion to dismiss already.

    Not to be too tin foil, but I have long thought that some dedicated CATO types spend their time calling up court clerks asking for tips about weird tort cases.  I only started to think this because of the thousands and thousands of cases filed throughout this country the media is fed information about their weirdest ones many filed in tiny courthouses in small counties that don't have a media outlet for miles around.

    Of course, this case is an exception in that it is a DC case, but so many come from towns no one has ever even heard of.  I know MSNBC doesn't have a reporter sitting in everyone of these tiny courthouses reading all of the lawsuits being filed.  I mean having started my career in PR, I happen to know that it is actually hard to get national media to pick up stories and they certainly rarely find many on their own - so I have to wonder who the PR machine is behind this kind of publicity.
