    ...would have to be invoked by Article I Section 8 clause 11 by the Congress, which presumes that a foreign enemy had attacked us or was a direct imminent threat to the United States, that would automatically by definition be paramount to our survival and therefore becoming priority #1 by default.

    A pre-emptive war started by Mister Bush under the 1973 War Powers Act wouldn't mandate a formal war declaration. By and under this statute, he can rain iron bombs on Iran with virtual impunity 24/7 for the first 60 days. He is only required to notify Congress during this time frame, informing them of his opinions of the threat and sketchy at best operational details-and that in secret behind closed doors meeting with a "chosen" few Senators and Congressmen.

    But with his disdain and utter contemptible opinion of Congress and his views of having near-dictatorial powers during wartime, I wouldn't hold my breath waiting for his timely explanation or consultation with Congress.

    Yes, without a formal war declaration, any pre-emptive war that Mister Bush starts could conceivably be construed as grounds for immediate impeachment. But would Congress choose instead to rally around this flag-draped Commander-in-Chief rather than to vote to remove him during a "national emergency", which of course would be solely defined by him? My money says once the bombs start falling on Tehran they would rally behind Mister Bush. He would then problably invoke some secret power he already has to remain in power for the duration of the emergency. (But this scenario is supposition and speculation on my part, and is a moot point. Congress could check and balance him still, no matter what he decides to do, but the real question is, would they?)

    This is precisely why impeachment is so paramount before he has the chance to test his theory or the powers this POTUS has been ceded by a heretofore supine Congress.
