    But we're talking about an Attorney General here. The president -- any and every president -- ought to be able to trust that his or her Attorney General is fully on their team, so to speak.

    Of course, we hope that the Attorney General is also ethical and honest enough a person not to lie down for extralegal subversion of the Constitution. That's obviously something that's required for the job.

    But this "administration" makes it clear up front that it will be engaging in such activities, and that it expects its Attorney General to defend such activities rather than prosecute them. That's extraordinary.

    And what's more, they expect the Attorney General to defend them by saying they were never really illegal or unconstitutional in the first place, and that all of you who thought they were are just a bunch of country rubes who need the protection of Papa President. That's even more extraordinary.

    So while I have no doubt at all that there are better nominees or better lawyers, I would say that Mukasey is more than adequate to the task. It's just that the task has been redefined into something that's impossible to execute and still be both ethical and a faithful servant of the president. I think that's pretty new.

    An "acceptable" nominee either has to break faith with the president who makes the nomination (an undesirable situation, generally) or break faith with the rule of law. The latter, of course, would be an indescribable loss and an enormous tragedy for this country.

    Now, how crazy is it that the United States Senate may opt for the indescribable loss and enormous tragedy over the undesirable situation, all in the name of not making waves?
