    the courts have done a better job than the Congress at protecting civil liberties from an overreaching Executive Branch.  If we now "close the courthouse door" against 40 or so current litigants, it's an open invitation for future abuse.  Why not go for indemnification of telcos instead?  Isn't the cost of lawsuits part of overall GWOT?  Isn't that cost small in the overall picture?  Isn't it likely that these suits will not be successful?  

    W: Telcos were operating in good faith in terms of damages..... but telcos would have to go through the process of lawsuits (boohoo)

    So it seems like Specter is saying why not just indemnify and let suits go on, because the plaintiffs are probably going to lose anyway??
