    torture has already been committed by Bushie and crew is kinda, um, after the fact isn't it?

    Then again, why should we need to put together a new law when we already have a law against torture in this country?  OH!  So Bushie and crew can be exhonerated for THAT waterboarding torture.  It's all clear now.

      retroactive immunity.

      Since it is unconstitutional to impose ex post facto punishment for a crime, and this bill establishes that Congress did not view waterboarding a crime prior, those who ordered or engaged in the torture are off the hook.

      It is illegal now. There is no honest doubt or dispute about it. This is just another way for the Democrats to let Bush off the hook.
