    given that these agents were operating under the Yoo "torture" memos that Jack Goldsmith, who succeeded him at OLC, eventually withdrew, at the time that these torture sessions took place (which in their minds and as explained to them rendered these sessions lawful, even if they were not), these agents could, I imagine, be gotten to testify without taking the 5th, and reveal much that we still do not know for sure about what happened--and, more importantly, implicate those who ordered or allowed these sessions to take place.

    Of course, these same people could just as easily claim to have been protected by these odious memos. But it seems less plausible to me that this would be held up in court given how high up they were in the chain of command. I mean, you can only pass the buck so much--and there's no way that it can end up on Yoo's desk, who can then claim "Well, to my lawyerly mind, this was all legal, so we're all off the hook".

    It seems to me more likely that the president will invoke some combination of Executive Privilege and States Secrets to prevent these agents from being able to testify--even in secret. But they might well bring out the Yoo memos to help complete their stonewalling.

    Ech, this is so messy, getting to the bottom of it all.
