    How are they supposed to "pre-empt" this?  It was clear that he was going to veto the bill and he did veto the bill.  The only possible disagreement here is whether he vetoed it by sending it back to Congress or whether he vetoed it by not signing it.  The White House will claim the former.  I would hope that everyone in the Congressional Leadership will claim the latter.  But in any case, the bill is vetoed.

      Bush's legal eagles are laying the groundwork for an attack on pro-forma sessions. I wouldn't be surprised if he tries to pick a constitutional fight by giving a recess appointment to a third under-assistant secretary of HUD in hopes that his tame Supreme Court justices will take another whack at legislative power.
