    No argument with the diary.  The Constitution makes no distinction in terms of session.  

    But, seriously, aside from putting out statements what can Pelosi and Reid do?  

    Not much IMO.  The real problem is that until the Democratic operatives - the people who go on CNN and the "Democratic" punditry - until they go on and start railing about this it just won't get traction.  Because right now the narrative is "Strong President, Weak Congressional Democrats" and short of impeachment (the very thought of which sends those consultants quiver) there just doesn't seem like much action Congress can take.  

    In many ways this is a battle for surrogates and we just suck as it - Democrats just can't get over the basic reality that facts don't win arguments but perceptions do.
