    I don't see any way we can get enough of them behind making that happen. I just don't think it's a realistic option at this point.

      ...we have Appeals Courts for when a court decision may "unfairly punish companies."

      Congress doesn't need to interfere by letting the FISA court throw out lawsuits.

      them behind the idea, inspite of what Feingold says here:

      I don’t think it should come down to letting the PAA expire. There are some areas where FISA needs updating and these fixes can be done in a noncontroversial way that protects the rights of Americans at home. It's the overreaching we see in the Intel bill and the PAA that are the problem. Congress should be doing its job, which is to fix the PAA.  

      I have faith in Feingold...but not in the majority of Congress and certainly not in this administration...if our hope for a good bill and good admendents is based on "Congress doing its job and fixing this"  it is not going to happen, especially when the Administration is demanding this one critical thing, telecom immunity.

      I know this line of thought may not be very productive...we have to work in the framework of what is realistic...still I think as progressives we can push the idea of COngress just letting this go for now...and taking it up at a later time.  

      Also realistically, President Bush and his Republicans are not going to let a bill pass that falls short of what they want most, removal of direct liability of Telecommunication companies....and we cannot let this happen even if that means not letting FISA come to a vote in any form.
