    My main worry about this amendment is that it will provide an easier mechanism to obstruct the lawsuits once the federal government becomes the defendant, claiming for example state secrets or executive privilege. But perhaps the court would consider those claims in the same way if the telecoms are defendants?

      for knowingly breaking the law.
      As I said above:
      The Government is us.
      So we would be liable...Our taxes will pay the settlements and legal costs.
      The telecommunication companies are entirely off the hook ( and with billion dollars  government contracts too!)

      With an outcome like this...what company is not going to join an illegal action proposed by the government in the future?
