I don't agree with it, and I believe criminalizing prostitution is a ridiculous practice (and clearly a failed one) but I do understand that there are some things that are illegal for which it's hard to make a cogent argument for maintaining illegal status, but which just FEEL wrong.  And sometimes your gut instinct is the right one to follow.

    •  I don't have a gut instinct here (6+ / 0-)

As a straight, when I think about homosexuality, I feel that it is wrong for me.  But that doesn't stop me from saying that I have the right to tell other men that they shouldn't do it.  I recoil at the thought of telling other people what to do as a general rule, and especially when no one is really hurt by it.

Same thing with prostitution.  I'm lucky enough to have a great wife, and don't need one.  But what if she passed away today?  Even dating would be impossible for a very long time.

I don't see what's all that wrong with it.

sometimes.  But usually not.  "Gut instincts" are usually the result of early childhood socialization, and as such, are about as intellectually complete and rational as the mind of a six-year-old.

Study after study after study has demonstrated that "instinctive" human thought is generally NOT rationally optimal.  That's why classical economic theory, which assumes "rational actors" is also usually wrong -- because most humans behave irrationally.
