    Ok, I was not clear enough.  Sorry about that.

    When we had the US vs. Nixon case in the 70s, there were four reliably liberal votes on the court in Brennan, Warren, Marshall and Douglas, plus a left-leaner in Blackmun and a moderate in Stewart.  Because of this, the four liberals drove the agenda.

    Now, there are four reliably far right votes in Alito, Scalia, Thomas and Roberts, plus a right-leaner in Kennedy and a left-leaner in Souter.  Because of this makeup, it is the right wingers who drive the agenda on the court.
