    Believe it or not, this is an improvement on their last decision on the area, where these toadies had declared, with a couple of honorable exceptions, that the President has the power, under the C-in-C clause, to detain American citizens captured within the United States, without charges, counsel, or the opportunity to be heard.

    And if you ever wondered about how lousy the Clinton adminstration was - they simply let this turd of a Circuit fester. Jesse Helms, that courtly gentleman, was allowed to blackball every black nominee that Clinton named to the then all white court.

    No need to even filibuster - the courtly Hatch let him do it, and the courtly Clinton didnt lift a finger to help those nominees.

    Decisions like this one are just the end of a long and painful series of shortcomings on the part of many.
