The Executive (at all levels) tends to treat the freedoms that the Bill of Rights grants us as maximums, rather than minimums.

It gives them carte blanche to repress the hell out of the populace, with the excuse that anything that they're allowed to get away with must be 'Constitutional'.

It's the kiddie matinée morality that pervades American politics: everything is either Evil or Good, so anything that hasn't been proved to be Evil must therefore be Good.

The people are indeed permitted to do anything that's not prohibited.  The agents of government are prohibited from doing anything that's not permitted.

Bushies would like to have the popular standard applied to them because, oddly enough, they reject the principle of limited government.

What they'd like to argue is that government responsibilities are limited to just two--keeping order and punishing miscreants--but their use of physical power to accomplish that is unlimited.  This is just the opposite of what the Constitution actually provides.  And, of course, they get to decide who the miscreants are.  LOL

How do you tell a predator from a protector? The predator will eat you sooner rather than later.
