    keep in mind that every single Supreme Court Justice wakes up with the screaming willies about being confronted with the "non-precedent precedents" they set in Bush v Gore.  even Fat Tony...  SCOTUS will not want to go near anything that looks even remotely like that case, and neither -- to the extent possible -- will state supremes or federal circuits.  

    whether this is ultimately a good thing or a bad thing remains to be seen, but it does make it a hell of a lot harder to intervene at the federal level.  

    too if Kerry can eke out an indisputable million or so lead in the popular vote it will be very very hard for the GOP to bully the courts in any particular battleground the way they did last time.  the GOP's only hope is in keeping the overall popular margin small enough that it won't look like an obvious coup and our only hope is to make sure it's big enough to be obvious...  

    that's why you need to vote -- and get others to the ballot -- even if you're in a safe state.

    there are other reasons -- both legal and sociopolitical -- to be cautiously optimistic about Kerry's position in a legal wrangle, but let's assume that there's only a very slim possibility that justice will prevail, and then only if we all stay alert and make our voices heard.

      Each and every vote for Kerry is important, red state, blue state or swing state.  The Bush plan in 2000 was if they had lost the Electoral vote but won the popular vote was to riot in the streets until they managed to swing some electors.  Wouldn't be hard since a lot of the electors are not public figures, and a constant riot at their house would be a big problem.
