    and a likely rationale to preclude stave off the GOP inspired probe?

    Could Brunner, Bauer et al simply argue that partitioning the 200K, or 600K Ohio recent voter/registrants is in effect unequal treatment under the law? That, in truth, if that test be demanded for that 600K then it must be applied uniformly against the entire database at the SOS Ohio?

    Such a task would not be seen as a reasonable requirement, but it is it a reasonable legal argument?

    There may be other, better arguments to aid Brunner's defense in the face of a GOP inspired, untimely investigation. Haven't read the Bauer piece yet, so it may already be alluded to.
