      ...she does not violate the black letter law.  On its face, the clause only applies to Senators and Representatives.  If she resigns her position in the Senate, she is no longer a Senator, regardless of how much of her term remains.

        You reckon if it were that simple, anyone would allow themselves to be caught in the web? Everyone else who has got caught in this did resign before they could take up their new job. Doesn't everyone have to resign their seat? The founders are no stupid. Read the letters of the provision. It applies to "the time for which s/he was elected", that is to say, 20 January 2007 to 19 January 2013, if I'm not mistaken.
