  •  oh, but it does... (0+ / 0-)

...consider the how and where of checkpoints siting as a perfect example...and, although i have no new jersey specific survey data, i would not be surprised to discover that in...some...neighborhoods, the way the motorist is treated is entirely different.

if the aclu is to be believed, a camden checkpoint would not be so likely to be a freindly event, which is considerably different than the experience you described--and the race of those stopped is likely to play a role in that difference.

is racial profiling not safety checkpoints...we have had troopers fired over racial profiling in NJ and we are working on it...safety checkpoints are part of the priveledge of driving in NJ...and I accept that as long as they do not extend the checkpoint into an illegal search outside the scope of plainview exceptions...

      •  i'm not comfortable... (0+ / 0-)

...with offering the police the power to make those choices--and i would go further nad suggest there are less invasive ways to achieve "safety".

require safety inspections before you get new tabs, for example...or every 6 months if you like...

see, the thing is, checkpoints don't have to be part of the driving experience--in nj, or anywhere else.

not to sound too much like john lennon...but imagine just going out on the road and going somewhere, with no irritation, no searches...and no feeling like you are under the thumb of a police state.

that's exactly how it is here in washington, and there is no way i want to allow the police here to have the powers you have to deal with there.

we have a governor who wants to change that, which was the impetus for these stories--and based on what i've learned, i will not be in her corner on this.

that is possible but SCOTUS has already ruled (before the current conservative court) that safety checkpoints are not constitutionally prohibited...I understand your concern/desire...not a big issue for me...
