    From Article I, Section 6, Paragraph 2:

    no person holding any office under the United States, shall be a member of either House during his continuance in office.

    You cannot do both at the same time. Which (currently) Senator Clinton is not doing. She's not Secretary of State. She will not be until such time as her appointment is proposed by President Obama, (which cannot happen until after he's inaugurated... Presidents-Elect have no authority to do anything... they're private citizens until they take the Oath,) and then confirmed by the Senate.

    So long as she submits her resignation from the Senate before being sworn into office as Secretary of State, she's good. She could do it on the podium of her swearing-in ceremony, so long as she says "I hereby resign my position as Senator from the State of New York, effective immediately" before she says "I, Hillary Rodham Clinton, do solemnly swear..."

    There is no Constitutional controversy here that cannot be solved by reading one's watch.

      ...chapter and verse. But Beck's idiocy goes beyond utter ignorance of the Constitution. He didn't even know what Joe was talking about. So he made up a separate problem that doesn't exist in reality and declared that to be the "real problem." Even after consulting with his "guys" who are "deep into the Constitution."
