    The Senate has the authority to judge not only the qualifications of its members (which was the issue in Powell), but also the elections and returns.  So, for instance, the Senate might block a prospective member on the grounds that he was fraudulently elected, even if he meets the age, residency and citizenship requirements.  

    Likewise with a fraudulent appointment, which this may well have been.  Under these circumstances, the Senate should investigate the matter before seating Burris.
