    Are you fucking serious? Don't you see it? Obama is saying, "I'm not interested in some kind of witch hunt. I'm too busy focusing on cleaning up the many immediate crises left to me by Bush. But at the same time, if Congress wants to exercise their investigative oversight duties--and I'm all in favor of that, since I swore an oath to uphold the Constitution--then that is something I support."

    It's the best of all worlds. Obama sticks to stimulus, health care, and climate change. The new DOJ will enforce subpoenas. And if wrongdoing is found, well, what is he supposed to do--ignore it? Why, that wouldn't be right. High-ranking officials shouldn't be treated differently than normal citizens. He wasn't looking to prosecute, but given the evidence uncovered by public testimony, well, he has no choice.

    This seems entirely transparent to me. And it's the right way to do it. Because it isn't a witch hunt. It is a simple, regular function of a democracy: we punish wrongdoers with due process.

    The DOJ just said it wasn't emphasizing prosecutions of lower level torturers who acted under orders. It didn't say anything about those who ordered torture. An I suppose lower level people accused of torture would have to prove somehow that they were, in fact, under orders...

    Obama is spinning a web.

      What was the first thing he said at the press conference when Leahy's proposal came up?

      No one is above the law.

      We'd like to think it's as simple as catching a burglar on tape with their hand in the till, but it's not.

      He's looking forward. He emphasizes this word choice every time the subject comes up.

      He's leaving the door wide open for other people.

        When I was driving up the street, listening to some news recap of his first news conference and he spent minutes saying his view on FICA was that his emphasis was disclosure. He just went on and on about it, explaining that the automatic preference would be toward disclosure. I mean, he went on about it. At the very first news conference? This is the emphasis? I gotta tell you, he got a lot of dap from me.
