    but how does this contrast with the SPLC vs the KKK where they successfully found that the rhetoric of the organization was responsible and liable for various violent actions performed by their members.

    In 1979, over 100 members of the Invisible Empire Klan, armed with bats, ax handles and guns, clashed with a group of peaceful civil rights marchers in Decatur, Alabama.

    Two marchers were shot in the head and face. Others were beaten with clubs and sticks. Forced to flee for their lives, they abandoned plans for a peaceful demonstration and sought safety.

    Though the FBI investigated and could not find enough evidence of a conspiracy to charge the Klansmen, the Center filed a civil suit against the Invisible Empire and numerous Klansmen. Center investigators uncovered evidence that convinced the FBI to reopen the case, and nine Klansmen were eventually convicted of criminal charges.

    The Center's civil suit was finally resolved around 1990. The settlement required Klansmen to pay damages, perform community service, and refrain from white supremacist activity.

    This was somewhat closer to "Somebody Should" GET 'Em Soon said over and over again rather than "Go Get 'em" right now!

    If the only difference is the time-lapse between the call to action and the action, then it's not much of a difference. Either way, it's a conspiracy to commit violence.

        interesting.  So in some ways Civil Liability might be brought against people like Goldberg by the victims and  survivors of Adkinsson?

            I think you could build a broader argument say against Fox News as an organization, not simply based on the Goldberg/Adkinnson Link - but including say Malkin (who has published the Addresses of activists knowing full well that it would lead to Death Threats against them), Coulter (How to Talk to a Liberal, If you have to), the guy who sent fake Anthrax to Olbermann and Stewart, The REAL Anthrax Attack on Leahy/Daschle, the murders of Abortion Doctors by associates of Hannity's good friend Randal Terry, suggestions that the NYTimes Building should be Bombed, the attempted assasination plot against SPLC chief Morris Dees, the Two Assasination Plots against Obama, and the girl who mutilated herself with an "O" - showing a regular pattern and practice of advocating not just disagreement - but deliberate incitement of violence against Democrats and Liberals using clips from their own shows culled from Crook & Liars, Media Matters, as well as Fox Attacks/BraveNewFilms that could be pretty powerful and convincing.

            I believe that much of that hate, fear and confusion coming from Fox News can be shown to be a desired influence on these events (particular with Moody's daily "Marching Orders" to the Fox Troops) in the same way that the Racist, Anti-Semetic and Violent Turner Diaries influenced Tim McVeigh, whose attack on the Murrah Federal Building duplicated an attack from the book on the FBI Building.

            And that with an African-American President and Democratic Control of Congress, the types of ideological domestic terrorism we saw with McVeigh and Rudolph is only more likely to repeat and escalate if we don't begin to take action sooner rather than later.
