    in the courts to rule against them, I might not be so upset about the DoJ arguing along  this "too secret to try" tack.

        but were our governmental institutions stronger in representing the principles of a free society upon which they were conceived, Obama could claim the power to give everyone in the country a noogie, and the courts would tell him to piss off.  Perhaps the most ominous part is that Bush felt and now Obama feels there's a chance these arguments would fly at all.

        I was thinking along the lines of how, in court cases where the government abused its power, it's important for the accused who's actually guilty to plead innocent anyway.  Test the system; force government officials to do it right, so that the rights of the rest of us get reinforced.
