    Terry Clark was executed for the kidnapping and murder of 11 year old Deena Lynn Gore from Artesia.

    While on Death Row, Terry was in solitary for his own protection because he was a prime target of many inside the system.  He wanted to have his execution carried out but volunteers from anti-death penalty groups worked feverishly to keep his case on appeal and the cause of opposing the death penalty alive.

    Clark hired our firm, a civil rights firm, to ask the Supreme Court to deny the appeals filed on his behalf and to set his execution date.  He had found religion while in prison, had made his peace and wanted to "pay his debt" to the victim and her family.  It was Terry's life and he wanted to have the right to say what happened to it, not be at the mercy of forces beyond his control.

    The Court agreed, and Terry Clark had his date set and was executed.  Years later I worked side by side with the attorney who prosecuted that case and we compared notes about the death penalty.  

    I believe the death penalty has no power over the minds of those who would commit crimes.  It also meets out little comfort to victims.  It is a burden on our system, a system that has proven it cannot reliably convict (witness the DNA evidence that has exonerated others).

    New Mexico is better off without the Death Penalty and I am proud of my state today.

      People who kill are not interested in the consequences at the time of their crime.

        When someone kills, they figure that they've either planned so carefully that there's no way they'll get caught, or they're so angry or crazy that they're not thinking of the consequences.
