    for your own ability to distinguish, does it? Greenwald has a nasty habit of putting things in terms of THE LAW, and not in terms of pejoratives.

      ...who I have found distorts the legal arguments in some cases. Not beyond the pale, but like a good lawyer often does when advocating a legal position.

      But, what he doesn't do is present the legal argument in a balanced manner.

      For example, has Glenn ever explained to his readxers that the despised state secrets privilege has been around since 1876? And it has been reaffirmed numersous times since then? I doubt it.

        Please read more closely. He's talking about more specific, more recent violations, and citing the letter of more recent laws that a president who you and I voted for is violating, and continues to violate.

          The Justice Department has reined in electronic surveillance by the National Security Agency after finding the agency had improperly accessed American phone calls and e-mails.

          The problems were discovered during a review of the intelligence activities, the Justice Department said in a statement Wednesday night.

          The New York Times, which first reported the matter on its Web site, said the NSA had been improperly intercepting communications by Americans.

          In its statement, the Justice Department said it has taken "comprehensive steps to correct the situation and bring the program into compliance."

          The Justice Department did not elaborate on what problems it found.

          Once corrective measures were taken, Attorney General Eric Holder sought authorization for renewing the surveillance program, officials said.

          Government officials have also briefed lawmakers on the issue.

          Sorry, but the handwringing going on here is ridiculous. The Obama Justrice department is doing its job here.

            a big distinction between NSA employees yucking it up over sex talk from overseas service people vs too many perhaps domestic only email headers and traffic info saved.
            There is no distinction made here in diary or most comments between content and outside the package info, and that is important. Without that, this is all or mostly whining about something we are going to do and be doing for a long time. It is another hyperbolic bunch of posturing and ranting...which while unclear can help pressure the admin...but still....
             Warrantless snooping into live or recorded content has better be with a warrant, and saving the header type info had better be supervised, I'm am no better informed by all this than I was an hour ago.
               I want the adults in charge, we need to keep the pressure on, but couldn't we be more accurate? To say 'no surveillance' is nuts, however righteous it may feel.
