    Scalia alone to attack as a "homophobe".

    Scalia is an intellectual who enjoys contemplating legal theory and applying it according to his views.

    Roberts and Alito are technocratic Republican/conservatives.

    Agree with him or disagree, Scalia enjoys the process of jousting over the law. Roberts and Alito enjoy conforming the law to what the Republican power base believes it should be.

    I don't think any of them are likely to come down on Frank's side on gay issues, but he'd have a better chanece with Scalia than with Alito and Roberts.

      Scalia rightly noted for instance when Lawrence v. Texas was ruled, that by overturning sodomy laws on an equal rights merit would open the door to an equal rights argument on overturning DOMA (which should be overturned IMNSHO). He may not like it and not want gay marriage, but he sees the goose for gander aspect of the claim.
