  •  There is a difference in saying that your (0+ / 0-)

personal experiences will influence your decisions and how your ethnicity and struggles will help you make better decisions than a white man.

If everyone here is going to be honest on the issue of the statement made by Sotomayor then they should wait for her explanation of it.

    •  if you read the entire statement (1+ / 0-)

you would already have an explanation for it

      •  I did read it. (0+ / 0-)

I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

The fact that it was used in realation to sexual discrimination cases is irrelevant.

This statement still has to be explained. If she could do that, she is a shoo in.

        •  I think this is a lot over not much (0+ / 0-)

She'll come to the hearings ready with something charming and self-effacing to say about the quote and it will disappear into the Supreme Court trivia file.

        •  I think the statement is fine. (0+ / 0-)

It needs no more explanation than someone saying her experience as a trial judge would, hopefully, be a plus.

The fact that it was used in realation to sexual discrimination cases is irrelevant.

Just as irrelevant as being a veteran is to being the Secretaru of Veteran's Affairs.  Or being a jduge is to being a Justice.  When you're immersed in the very subject at issue, you tend to know something about it.

You're better off reading Josh Marshall in the first place.

          •  But the point is your ethnicity, sex, religion (0+ / 0-)

etc. doesn't mean that you will come to a better decision than a white male, different perhaps. In fact, it's quite possible that you will come to a far worse decision.

            •  She didn't say it would. (0+ / 0-)

She said she hoped it would, just as I hope that her being a trial judge makes her a better justice, just as I hope being a vet makes the secretary a better secretary for veterans' affairs. We hope so and think so, given that we in fact appoint people based on these backgrounds.

              •  That would be fine if she didn't include (0+ / 0-)

the part about reaching a better conclusion than a white male.

"I would hope that a wise white male with the richness of his experience would more often than not reach a better conclusion than a Latina woman who hasn't lived that life."

Now what if this was said.

Don't tell me that is what Alito said, because it is not.

    •  Why did Reagan go out of the (0+ / 0-)

way to appoint a woman and to promote the fact that he was doing it if he didn't believe in some way that she would make better decisions that the available white men? You've seen the clips of Reagan broadcasting before the fact that he would choose a woman? What was that all about?

      •  you can say that you can bring a fresh (0+ / 0-)

perspective to the table, but not that your decisions are going to be better based on your race.

        •  A fresh perspective is ok (1+ / 0-)

but shouldn't be confused with being a better perspective? I think we're getting into needles on a pin territory.

          •  A fresh perspective doesn't necessarily mean (1+ / 0-)

a better viewpoint, only one coming from a different direction. To say that one can make a better decision based on their race is wrong, plain and simple. If you can reasonably explain the statement then I am satisfied.

No one here would accept the same statement from a white male.

            •  DIfferent for it's own sake? No. (0+ / 0-)

Different because it's hopefully better.  Like she said.

Your premise that bringing in perspectives is good in and of itself even if it doesn't result in any better perspectives makes the court seem like a legislature.

No one here would accept the same statement from a white male.

Because minorities are pretty well educated in the world of the white male just by living here, largely working for us and coming in contact with us on a daily basis.  We're easily observed.  No surprises there.

    •  her speech (0+ / 0-)

What she said in the speech following the remarks everyone is focusing on essentially puts them both in context and reveals that far from being pre-disposed towards anyone, she would be extra cautious....In short, her own words get her out of any "trouble".
