I served on a jury of a guy who was charged because he spat on a police officer in the patrol car. There's a specific statue here in Colorado for using bodily fluids as a weapon against a peace officer in a jail or equivalent setting. Evidently the origin was prison guards getting the "Silence of the Lambs" missile flung at them by HIV positive inmates.

    •  I think I recall that case, or one similar. (1+ / 0-)

Wasn't it on the national news a about a year or so ago?

In any case, thanks for serving on the jury.

Guy was drunk out of his mind, and the statue required an intent to do harm, so we found for a lessor charge of interfering with the activities of a peace officer, since he'd also kicked out the window of the police car, thrown such a fit he had to be restrained with ankle restraints, et cetera.

Stupid kid got drunk and belligerent, got locked out of his apartment by his frightened wife, and things went south from there. I couldn't see convicting him of a felony.
