    This silly argument that "my client is over 80, so any sentence more than a couple years is a life sentence" is utter crap.  It implies that once you reach a certain age, you can get away with murder.

    150 years is also crap, and it feeds from the same ridiculous argument about any prison term at all being a life term.  If that's indeed the case, one might argue, why not throw the book at him?  Utter nonsense.

    The same sentencing guidelines should apply to elderly criminals as 20 year olds.  The convict's age should not enter into it until he reaches the corrections system.  I doubt Madoff is going to Sing Sing or any place like that (at least I hope not), so it shouldn't matter if the sentence exceeds the man's life expectancy, only that it's appropriate for the crime.
