    There are so many other areas of jurisprudence from which arguments can be culled- de facto discrimination, voting rights act, civil rights act, rts to vote, interpretation of HAVA (which still has not been interpreted  by Cts) etc.

        by the BOE's own guidelines the polling place requiring ten machines (one per 100 voters), the polling site had only three machines, one less than for the 2000 elections.

        that sounds pretty conclusive right there - they violated their own guidelines.  invaled vote, game over.

      Maybe it's time to start occasionally checking Findlaw's nationwide VOTING CASES and INVESTIGATIONS.

      Incidentally, the Ohio Dems have been on this at least since 5:53 pm on Election Day (first Ohio entry at link above), when they filed a complaint to attempt a quick fix (issue paper ballots) to the problem of inadequate machines causing long lines:

      ...Voting in Franklin and Knox counties is grinding to a halt. Because of a failure to supply an adequate number of voting machines, thousands of Ohio voters may be disenfranchised if this Court does not take immediate action...
