    How about an amendment to the California Constitution:

    Nothing in this Constitution shall be construed to either require the State of California to allow or recognize same sex marriages or to prohibit it from doing so.  Whether or not to allow and recognize same sex marriages is a political question that shall be determined by the legislature or the voters through the normal initiative process.
