  •  The only valid reason for not (0+ / 0-)

doing so would be that it might hamper the prosecution of the real thing.

We have a law that requires that people producing fake kiddie porn with adults prove that all the people who take part really are adults.  If there were a way to provide similar proof that computer-generated porn really generated from scratch,  there would be no legitimate reason to ban it.

    •  there was a case some years ago.... (0+ / 0-)

...where a guy was convicted of possessing kiddie porn because he had cut out a bunch of pictures of kids from a Sears catalog and pasted them into some kind of scrap book he used as wank-fodder.

Just this year, a comic book collector was sentenced to a long prison term for having Japanese "manga" that depicted nudity: in Japan, showing pubic hair is the legal definition of porn, so nude cartoons have to show hairless nudes, which in the USA makes them look like children.

Now IMHO that's going too far: those instances are basically thoughtcrime.

And in point of fact I agree that "synthesized" kiddie porn ought to be legal because no real kids are abused.  Whether or not that stuff makes most of us want to puke is irrelevant; after all we don't have to look at it.

As a generalization, the legal treatments of explicit sex and explicit violence ought to be identical.  The abject hypocrisy of the double-standard in this area is disgusting and has no rational basis whatsoever.  But that's another debate for another day.
