    what it sounds like, that your friend is now being threatened with a harsher sanction (jail time) in retaliation for contesting a relatively milder sanction (monetary penalty)?

    Can it be legal to elevate the charges or punishment for an alleged offense, after the fact, just because the person charged has requested their day in court? It certainly seems unfair.

      The problem is that media typically report a violation "carries a penalty up to $XXX and jail time up to XX days/years/whatever."  The media do not report that the typical penalty is, except in the most egregious cases, far less than the maximum penalty.  If this case does not get tossed, he'll probably end up with a $20 fine and no jail time.
